Reporters Without Borders voiced concern today about the Computer Crimes Act that took effect on 18 July. It allows the police to seize the computer files and online files of persons suspected of disseminating insulting or pornographic content.

“The Thai military government is using the fight against pornography to conceal an increasingly restrictive policy towards online free expression,” the press freedom organisation said. “The government must combat online criminality and the sexual exploitation of human beings without committing new violations of free speech or personal privacy.”

Silpakorn University philosophy lecturer Asst. Prof. Boonsong Chaisinghanon has told Prachatai that he has refused to hand over examination papers and score details from his Thai Civilization courses. The materials were requested by the Acting Dean of the Faculty of Arts, asking for them to be handed over by 20 July to allow the police to press lèse majesté charges against him. Asst. Prof. Boonsong claims that doing so will affect the rights of his students, since the answer sheets should be viewed only by the instructor. It is therefore beyond his powers to hand over the examination papers and the score details. The Acting Dean would have to take responsibility for the consequences of overriding this decision, he said.

“The fateful knock came in the middle of the night, bringing me into a life without light.

They took me away from my family. They threw away my rights and my dignity.”

The draconian Internal Security Act (ISA) has long been used by governments to stifle peaceful political dissent. One of the more unfortunate legacies from British times, it is still in use in countries such as Malaysia, Singapore and Brunei.

Reginald Hugh Hickling (who died earlier this year), the British lawyer who first drafted the ISA, wrote in 1989, “I could not imagine then that the time would come when the power of detention… would be used against political opponents, welfare workers and others dedicated to nonviolent, peaceful activities.

Considering the amount of criticisms leveled against the ISA, and the available evidence pointing to the ISA as a severe abuse of human rights and civil liberties, it is troubling to note that Thailand and the Philippines are now considering installing similar laws.

Thai Independent Media at documenta 12

Documenta is an international art event that is held every 5 years in the city of Kassel [Germany]. It’s 12^th documenta, documenta 12, opened in June and have already drawn thousands of visitors. One of the main projects of documenta 12 is the magazines project. For the first time in the documenta history, magazines are taking part as a mediator and a navigator to connect theory and practice in art, audience and artists, and art and society. After years of research more than 90 printed periodicals and on-line media have been invited to this innovative project. From Thailand, one bookazine entitled “Bangkok Documenta Magazine”, that was created by contributions of six printed periodicals and on-line media, is participating in the magazines project. And on Aug.11, four editors are invited to talk about the current situation of politics and media in Thailand as a lecture from 1 to 2pm at documenta halle. For the first time in Europe, four of the most important media in Thailand will talk about the true nature of Thai politics, the latest situation, and the forecast of the future for the international audience.

New Thailand cyber law gives police access to home computers — JURIST

[JURIST] Thailand’s 2007 Crimes Act [The Nation – Bangkok report] became effective Wednesday, granting authority to Thai police to confiscate and search private computers. The law is reportedly aimed at reining in Internet pornography and libel, with some violations that threaten national security carrying prison sentences of up to 20 years. Internet service providers will be required to keep individual user records for 90 days. Critics, such as rights group Freedom Against Censorship Thailand [advocacy website], fear that the Act gives police broad power to invade citizens’ privacy.

In April, the Thai government banned access [JURIST report] to the popular video-sharing website YouTube [corporate website] and several other websites that contained material deemed offensive to the country’s monarch King Bhumibol Adulyadej [official profile]. Earlier this month, the nation abandoned a law [JURIST report] that allowed the cabinet to censor political or controversial Internet sites solely at the discretion of the Minister of Communication, instead providing that websites be censored only by court order. YouTube and about 45,000 other websites are currently blocked. The majority of the banned sites feature pornography or support former Prime Minister Thaksin Shinawatra [JURIST news archive], who was removed from power during a bloodless coup in September 2006. (Hong Kong, July 23, 2007) An online petition has been launched in support of a Thai lecturer who has been accused of insulting the monarchy through the questions asked in a university examination paper.

Boonsong Chaisinghanon, who teaches philosophy at Silpakorn University, has been asked by its administration to hand copies of his examination papers over to the police “to be used in the preparation of evidence for lèse majesté charges”.
